The power exercised by technology companies is attracting the attention of policymakers, regulatory bodies and the general public. This power can be categorized in several ways, ranging from the “soft power” of technology companies to influence public policy agendas to the “market power” they may wield to exclude equally efficient competitors from the marketplace. This Article is concerned with the “data power” exercised by technology companies occupying strategic positions in the digital ecosystem. This data power is a multifaceted power that (...) may overlap with economic (market) power but primarily entails the power to profile and the power to influence opinion formation. While the current legal framework for data protection and privacy in the EU imposes constraints on personal data processing by technology companies, it ostensibly does so without regard to whether or not they have “data power.” This Article probes this assumption. It argues that although this legal framework does not explicitly impose additional legal responsibilities on entities with “data power,” it provides a clear normative indication to do so. The volume and variety of data and the reach of data-processing operations seem to be relevant when assessing both the extent of obligations on technology companies and the impact of data processing on individual rights. The Article suggests that this finding provides the normative foundation for the imposition of a “special responsibility” on such firms, analogous to the “special responsibility” imposed by competition law on dominant companies with market power. What such a “special responsibility” might entail in practice will be briefly outlined and relevant questions for future research will be identified. (shrink)

ABSTRACTOn 28 October 2012, Savita Halappanavar, an Indian woman living in Ireland, died in hospital while under medical care for a miscarrying pregnancy. According to her husband, her repeated requests for an abortion were ignored because of the presence of a foetal heartbeat. Ms Halappanavar’s death was a critical event in the process leading to a referendum on 25 May 2018, when the Irish electorate voted to repeal the Eighth Amendment of the Constitution, removing the constitutional ban on abortion. The (...) name Savita has become indelibly linked to the changing course of abortion politics, so it is timely to reassess the role of the media in shaping the parameters of the debate about the impact of her death on the issue. This study presents a frame analysis of Irish newspapers in the weeks following her death, mapping the political, medical, legal and socio-ethical discourses, as well as the related contemporaneous events that set the agenda for the type of debate that was to follow. It identifies four media frames: Public Tragedy, Political Opportunity, Abortion Legacy and Maternal Health. Our central argument is that the overall effect of media framing provided much face-saving for politicians in the way that the legislative issue was viewed through a conservative party-political lens, despite public outrage. This essay is an attempt to think through some of the problems of idolatry and sacrifice for the early modern period and more generally, for the constitution of religious and political community. In particular, it argues that the altars of the idols condensed two problems: first, the problem of communion, and specifically the Protestant ability to communicate with God; and second, the problem of distinction. At a time when the nature of the religious polity was in question, the analysis of (...) idolatry and sacrifice produced a conceptual structure for understanding, in anthropological fashion, the very constitution of religious and political community. In fact, this essay will suggest, this structure lives on, alive and well, among modern theorists seeking to diagnose the ailments of modernity. (shrink)

Population-level biomedical research has become crucial to the health system’s ability to improve the health of the population. This form of research raises a number of well-documented ethical concerns, perhaps the most significant of which is the inability of the researcher to obtain fully informed specific consent from participants. Two proposed technical solutions to this problem of consent in large-scale biomedical research that have become increasingly popular are meta-consent and dynamic consent. We critically examine the ethical and practical credentials of (...) these proposals and find them lacking. We suggest that the consent problem is not solved by adopting a technology driven approach grounded in a notion of ‘specific’ consent but by taking seriously the role of research governance in combination with broader conceptions of consent. In our view, these approaches misconstrue the rightful location of authority in the way in which population-level biomedical research activities are structured and organized. We conclude by showing how and why the authority for determining the nature and shape of choice making about participation ought not to lie with individual participants, but rather with the researchers and the research governance process, and that this necessarily leads to the endorsement of a fully articulated broad consent approach. All too often, the requirements for actionability and accountability of data infrastructures are conceptualised as incompatible and leading to a trade-off situation where increasing one will unavoidably decrease the other. Through a comparative analysis of two data infrastructures used to share genomic data about the SARS-COV-2 virus, we argue that making data actionable for knowledge development involves a commitment to ensuring that the data in question are representative of the phenomena being studied and accountable to data subjects and users. This (...) in turn presupposes that: (1) enough data are contributed by a wide and diverse set of relevant sources; (2) mechanisms of feedback and inclusion are set up to ensure that data contributors can participate data governance and interpretation, thereby helping to adequately contextualise data; and (3) accountability extends to the ways in which data infrastructures are run, financed and positioned vis-à-vis the communities they are meant to serve. Such a model of data sharing can only work on the understanding that data do not need to be easily accessible to be actionable; rather, actionability depends on the responsiveness and accountability of data infrastructures, and the efforts invested in ensuring open communication among contributors. Currently, research ethics committees in the UK meet behind closed doors—their workings and most of the content of their decisions are unavailable to the general public. There is a significant tension between this current practice and a broader societal presumption of openness. As a form of public institution, the REC system exists to oversee research from the perspective of society generally.An important part of this tension turns on the kind of justification that might be offered for the REC system. In (...) this paper I adapt Daniels and Sabin’s accountability for reasonableness model for just resource allocation to the research ethics context to provide some structural legitimacy and to enable progress on the question of openness. After considering the consequences of adopting this model for open REC meetings, I then examine some reasons that might be offered against open meetings. These arguments do not overwhelm the core intuitions behind the presumption of openness but they do, I suggest, give us reason to retreat from fully public meetings. I conclude that there should be important adjustments to the system towards public accountability and that there are grounds for stopping short of fully public meetings. (shrink)

When it comes to using patient data from the National Health Service for research, we are often told that it is a matter of trust: we need to trust, we need to build trust, we need to restore trust. Various policy papers and reports articulate and develop these ideas and make very important contributions to public dialogue on the trustworthiness of our research institutions. But these documents and policies are apparently constructed with little sustained reflection on the nature of trust (...) and trustworthiness, and therefore are missing important features that matter for how we manage concerns related to trust. We suggest that what we mean by ‘trust’ and ‘trustworthiness’ matters and should affect the policies and guidance that govern data sharing in the NHS. We offer a number of initial, general reflections on the way in which some of these features might affect our approach to principles, policies and strategies that are related to sharing patient data for research. This paper is the outcome of a ‘public ethics’ coproduction activity which involved members of the public and two academic ethicists. Our task was to consider collectively the accounts of trust developed by philosophers as they applied in the context of the NHS and to coproduce an argumentative position relevant to this context. In his book Reveille for Radicals, Saul Alinsky writes, "Most people are eagerly groping for... some way in which they can bridge the gap between their morals and their practices". Today, many consumers try to bridge that gap by participating in what has been termed ethical consumption: the intentional purchase of products and services that the customer considers to be ethically produced. But what happens if consumer perceptions do not match reality? This study investigates one aspect of ethical consumption by (...) examining consumer perceptions of the term cruelty free. Various definitions of this term exist, and companies can use the term when the product or its ingredients were indeed tested on animals. This exploratory study suggests that many consumers use this term as a moral heuristic in decision-making. As a result, the use of the term creates a halo effect that elevates brand perceptions. When provided with information suggesting the heuristic is flawed, consumers slightly alter perceptions but attitudes remain relatively strong. While some countries have implemented regulation regarding the use of the phrase in some contexts, results suggest that a broader policy is necessary to correct misperceptions and avoid misleading consumers. Results from a crowdsourced audio questionnaire show that inflected infinitives in Galician are still acceptable in a broad range of contexts, different from those described for European Portuguese. Crucially, inflected infinitives with referential subjects are widely accepted only inside strong islands in Galician (complements of nouns, adjunct clauses). They are widely rejected in non-islands, notably in the complements of epistemic/factive verbs, in contrast with Portuguese and older varieties of Galician (Gondar 1978, Raposo 1987). Statistical analysis shows, however, that, in the (...) complements of epistemic/factive (and desiderative) verbs, inflected infinitives are significantly more acceptable in instances of control, whether partial or exhaustive. In fact, there is no significant difference between these two types of control in Galician, unlike in Portuguese, where inflection is generally better in instances of partial control and is not acceptable in instances of exhaustive local subject control (Modesto 2010, Sheehan 2018). We propose an analysis of this pattern in terms of phase theory. The inflectional domain of non-finite clauses remains visible to the thematic domain of the next clause up, according to the less strict version of the Phase Impenetrability Condition (Chomsky 2001), allowing control to take place. Pronouns/or pronominal inflections in the inflectional domain of visible non-finite clauses therefore get controlled. In islands, however, material in the inflectional domain remains free/referential. Despite this basic pattern, the data are characterized by substantial interspeaker variation. Statistical analysis shows that gender, urban/rural birthplace and mother tongue are all significant factors in this variation, while age and region of birth are not. Most notably, urban-born male bilinguals with Spanish as their mother tongue consistently rate the sentences higher on the Likert scale. Overall, the results show that crowdsourcing can lead to empirically robust syntactic descriptions of minority languages which are likely to be subject to substantial sociolinguistic variation and where judgements from a single social group may be misrepresentative of the general picture. The study also highlights, however, the challenges associated with using crowd-sourced audio-questionnaires of this kind in languages of this kind and the need for statistical analysis of results to control for substantial amounts of variation. The essay draws on Heidegger's lecture courses, published and unpublished, particularly "On the Being and Conception of Physis." After introductory remarks on how Heidegger reads Aristotle "phenomenologically" in general, the essay focuses on how Heidegger reads physis as a mode of Being (ousia) by reading kinesis as a mode of Being, specifically as energeia ateles (incomplete Being). But energeia ateles is characterized by (...) Heidegger as Wiederholung (retrieve of possibility) and as Eignung (appropriation of dynamis for appearance). On the basis of that crucial reading of physis, the essay goes on to show how physis-as-dynamis is the foundation for Ereignis in Sein und Zeit through the radical transformation of Wiederholung in natural beings into resolve in Dasein. Increasing numbers of marketers are turning to the crowd—members of the public engaged with brands via the Internet—to develop marketing and advertising campaigns. Some marketers use social media to connect directly with customers, while others use crowdsourcing agencies to harness the power of crowd labor. As more members of the public become aware of creative crowdsourcing, they look to the media to understand more about it. As a result, it is important to examine how the media currently frame creative crowdsourcing (...) to the public, particularly when numerous ethical issues about crowdsourcing have been identified. This study examines media coverage of creative crowdsourcing to examine how benefits and challenges are presented. Informed by a framework developed by Swain, results indicate that most media coverage focuses solely on benefits to the industry: benefits to the ‘crowd’ are rarely discussed, yet drawbacks to the crowd are mentioned more frequently than drawbacks for the industry. This provides a skewed vision of what creative crowdsourcing is and may affect participation in the practice. (shrink)

An examination of the evidence for and the theoretical implications of a universal word order constraint, with data from a wide range of languages. This book presents evidence for a universal word order constraint, the Final-over-Final Condition (FOFC), and discusses the theoretical implications of this phenomenon. FOFC is a syntactic condition that disallows structures where a head-initial phrase is contained in a head-final phrase in the same extended projection/domain. The authors argue that FOFC is a linguistic universal, not just a (...) strong tendency, and not a constraint on processing. They discuss the effects of the universal in various domains, including the noun phrase, the adjective phrase, the verb phrase, and the clause. The book draws on data from a wide range of languages, including Hindi, Turkish, Basque, Finnish, Afrikaans, German, Hungarian, French, English, Italian, Romanian, Arabic, Hebrew, Mandarin, Pontic Greek, Bagirmi, Dholuo, and Thai. FOFC, the authors argue, is important because it is the only known example of a word order asymmetry pertaining to the order of heads. In Invisible Hands, the historians Jonathan Sheehan and Dror Wahrman identify a defining feature of the eighteenth-century Enlightenment: the decline of God as a source of order in favor of a new model of self-organization.” Sheehan and Warhman provide a novel account of how people on the threshold of modernity understood the continuing presence in the world of apparent disorder, randomness, and chance. If God no longer actively guaranteed that order will always prevail, what or whom did? Can films philosophize rather than simply represent philosophical ideas developed outside of the cinematic medium? Taking up this question crucial to the emergent field of film philosophy, this book argues that the films of the American avant-garde do "do" philosophy and illuminates the ethical and political stakes of their aesthetic interventions. The book traces the avant-garde's philosophy by developing a history and theory of its investment in dimensional, conceptual, and material in-betweens, clarifying how this cinema's reflections on the creation and (...) reception of images construct an ethics of perception itself, a responsibility to perpetuate thought in an enduring re-encounter with the world and with meaning's unfinished production. This entails the avant-garde's locating of cinema's-and thought's-ends or meanings in their means, and their advancement of an image of truth that is made rather than found that unites their films with the philosophies of Ludwig Wittgenstein and Ralph Waldo Emerson who believed the "journey's end is found in every step of the road" (Cavell). Rectifying film-philosophy's neglect of the American avant-garde, the book demonstrates how rather than showing their interest in the revelation of authoritative truths, the avant-garde's interest in the re-encounter and review of the seen and known emerges from an American Transcendentalist tradition that opposes such notions. Sheehan reads the avant-garde's interest in the contingencies of spectatorial experience as also an extension of Pragmatism's commitment to replacing the authority of a priori knowledge with that of individual experience. She also shows how Emerson's influence on Friedrich Nietzsche connects the American avant-garde's philosophies to Deleuze's time-image, premised largely upon Nietzsche's "powers of the false.". The applicability of Nagel's concept of theory reduction, and related concepts of reduction, to the reduction of genetics to molecular biology is examined using the lactose operon in Escherichia coli as an example. Geneticists have produced the complete nucleotide sequence of two of the genes which compose this operon. If any example of reduction in genetics should fit Nagel's analysis, the lactose operon should. Nevertheless, Nagel's formal conditions of theory reduction are inapplicable in this case. Instead, it is argued that (...) genetics has been partially reduced to molecular biology in the sense of token-token reduction. (shrink)

In the decades since Martin Heidegger's death, many of his early writings--notes and talks, essays and reviews--have made it into print, but in such scattershot fashion and erratic translation as to mitigate their usefulness for understanding the development, direction, and ultimate shape of his work. If the debates started in religion, however, they quickly generated political, philosophical, anthropological, and even scientific corollaries. These may appear to be abstract and theoretical questions, but (...) they produced a complex set of answers with important consequences for many people. To see what was at stake, we need look no further than the New World and its missions. If the most frequently cited texts in the collection of articles are Bartolomé de las Casas and José de Acosta, it is because the New World forced the reality of idolatry onto the wider European stage.When does an image become a god? The early Christian apologist Minucius Felix had an answer. A log "is cut, is hewn, is planed," and is still no god. A stone "is sculptured, and is polished by some abandoned man" and still is no god. A sculpture "is set up, and even yet it is not a god." But, "lo, it is adorned, it is consecrated, it is prayed to—then at length it is a god, when man has chosen it to be so, and for the purpose has dedicated it." 1If only it were that easy. Felix offered just half of the story as David Freedberg has argued. Veneration does not produce that unhealthy power that idols exert over the attentive viewer. Rather, the opposite is true: idols are venerated because they exert this power. All images seem to contain at least traces of it. They draw our eye with ineluctable command, and force themselves on our attention. The image is just a representation, of course. It has been made by humans and can only ever gesture to an absent presence. And yet, images are also effective. Their ability to move us depends on "the possibility of fusion" between image and prototype. The crucifix is always only wood or stone, but its power comes from what might be called, with Freedberg, a "sacred contagion" that penetrates from behind the veil of representation. Indeed, its value as a religious object depends on this [End Page 561] contagion. Worshipers know that those tears shed by the Virgin in anguish at Christ's broken body are, in reality, just paint over mute stone and wood. Nevertheless, they are moved by those specks of material. If not, why have a statue in the first place? "The miraculous object has an effectiveness that proceeds as if the original body were present," Freedberg notes, "but the difficulty lies in cognitively grasping that 'as if.'" 2 Men do not choose to invest images with power over their imaginations and intellects. Even before images are prayed to, before they are consecrated, they already have that power.Whatever one thinks of the phenomenology of images, there is no doubt that this super-human power of idols obsessed many people in the early modern period. An object that had no power to inspire attention and devotion was hardly a threat, after all. The enormous waves of iconoclasm that swept across Europe—Germany in the 1520s, Scotland in the late 1550s, the Netherlands in the 1560s, England in the 1640s—were not directed at decorative tiles, pews, or doorstops. They were directed exactly at those things that made the devout feel the presence of the divine. And no one was quicker to identify these powerful images than the breakers themselves, who, in their extreme acts of rage, confirmed the effects that these supposedly dead bits of wood and stone exerted over them. The man in Ulm in 1534 who defecated into "the mouth of an effigy of Christ" demonstrated his extreme revulsion at what was, in reality, merely a lump of brute material. 3 Perhaps, if asked, he would have insisted that his scatological exuberance was designed to show definitively the impotence of the... Many of us first met this translation some twenty years ago in its then typed format--690 double-space pages replete with hundreds of handwritten corrections. Now two decades later, a glance at that earlier manuscript reveals that little has changed in the intervening years: The published book is virtually identical to the earliest typed manuscript. So too, the Introduction here (JS 1-35) is the same one that appeared in Basic Writings (1977, 41-89), with only minor orthographical changes.

There is a growing body of literature that has sought to undermine systems of ethical regulation, and governance more generally, within the social sciences. In this paper, we argue that any general claim for a system of research ethics governance in social research depends on clarifying the nature of the stake that society has in research. We show that certain accounts of this stake—protecting researchers’ freedoms; ensuring accountability for resources; safeguarding welfare; and supporting democracy—raise relevant ethical considerations that are reasonably (...) contested. However, these accounts cannot underpin a general claim in favour of, or against, a system of research ethics governance. Instead, we defend governance in social research on the grounds that research, as an institutionalised form of enquiry, is a constitutive element of human flourishing, and that society ought to be concerned with the flourishing of its members. We conclude by considering the governance arrangements that follow from, and are justified by, our arguments. (shrink)

In the Early Modern era of encyclopedias, the Bible functioned as a tool for managing and organizing the superabundance of information. From Johann Alsted to Johann Scheuchzer, this paper traces the use of the Biblical encyclopedia and the ways that the Bible was deployed to control the data that flooded the world of Early Modern scholarship. In a variety of contexts, the Bible served as a structure for generating meaningful statements from informational noise. In turn, the use of the Bible (...) as a principle of organization would have profound implications for the status of the Bible in Early Modern scholarly culture. (shrink)

This article outlines the distinctive contribution of Marxism to science studies. It traces the trajectory of Marxist ideas through the decades from the origins of Marxism to the present conjuncture. It looks at certain key episodes, such as the arrival of a Soviet delegation at the International History of Science Congress in London in 1931, as well as subsequent interactions between Marxists and exponents of other positions at later international congresses. It focuses on the impact of several generations of Marxists (...) who have engaged with science in diverse ways. It examines the influence of Marxism on contemporary trends in science studies. It concludes that Marxism survives in circuitous and complex ways. It argues not only for a positive interpretation of its contribution in the past but for its explanatory and ethical power in the present and future. (shrink)

It is very significant that Heidegger chose Die Grundprobleme der Phänomenologie, the lecture course he gave in the summer semester of 1927, to be the first publication in his monumental Gesamtausgabe.1 The text is rich in many ways, but one of its major claims to fame may rest in a footnote, taken from Heidegger's own manuscript of the course, that appears on page 1 of the published version. This elliptical footnote, which in fact functions like a subtitle for the whole (...) volume, asserts that the lecture course represents a "New elaboration of Sein und Zeit, Part One, Division Three.". Early in his career he came under the influence of Edmund Husserl, but he soon broke away to fashion his own philosophy. His most famous work, Sein und Zeit (Being and Time) was published in 1927. Heidegger's energetic support for Hitler in 1933-34 earned him a suspension from teaching from 1945 to 1950. In retirement he published numerous works, including the first volumes of (...) his Collected Edition. His thought has had strong influence on trends in philosophy ranging from existentialism through hermeneutics to deconstruction as well as on the fields of literary theory and theology. (shrink)
